Spam Policy

Sending unsolicited commercial email (spam) through the SureContact system is strictly prohibited. Any customer that uses UCE/Spam in their marketing efforts is subject to immediate termination and will be subject to prosecution to the fullest extent of the law.

Customer must agree to the terms stated in this No Spam Policy before submitting a list of contacts to be emailed.

Customer represents, covenants, and warrants that Customer will use the Services only in compliance with SureContact’s No Spam Policy and in compliance with all applicable laws (including but not limited to policies and laws related to spamming, privacy, obscenity, or defamation).

Customer may not access or otherwise use third party mailing lists in connection with preparing or distributing unsolicited email to any third party. Customer represents, covenants, and warrants that all email addresses submitted are of persons with whom they have a relationship with and that the person provided their email address to the customer as a desired means of communication.

Customer hereby agrees to indemnify and hold harmless SureContact, Inc. against any damages, losses, liabilities, settlements, and expenses (including without limitation costs and reasonable attorneys’ fees) in connection with any claim or action that arises from an alleged violation of the foregoing. Although SureContact, Inc. has no obligation to monitor the contacts provided by Customer, SureContact may do so and may remove any such contact or prohibit any use of the Services it believes may be (or alleged to be) in violation of the foregoing.
